SB 1039: Finchem Measure Would Hold the State Bar Accountable for Failed Discipline Cases

Senator Mark Finchem, joined by Senator Wendy Rogers, has introduced SB 1039, a bill that would protect attorneys from unjust discipline actions and require accountability when investigations fail.

Attorney discipline investigations can be long and damaging, even when an attorney is ultimately cleared. Legal costs rise, income is lost, and reputations can suffer permanent harm.

If passed, SB 1039 would require the State Bar to pay attorney fees, court costs, and lost earnings when an attorney prevails in a discipline case. The bill would also allow attorneys to seek damages if their reputation was harmed by a failed investigation.

This measure would encourage careful, evidence-based investigations and discourage reckless or politically motivated actions. It would help ensure discipline powers are used fairly and responsibly.
