SCR 1008: Finchem Advances Voter-Driven Clarification of Arizona Surrogacy Contract Law

Senator Mark Finchem has introduced SCR 1008, a concurrent resolution that would submit a technical correction to Arizona’s surrogacy-related contract law directly to voters at the next general election.

The resolution proposes a narrowly focused amendment to Arizona Revised Statutes §25-218, which governs surrogate parentage contracts. The change clarifies existing statutory language to ensure consistency and legal certainty regarding parental presumptions in cases involving surrogacy, while maintaining Arizona’s longstanding prohibition on surrogate parentage contracts.

Rather than imposing the change unilaterally, SCR 1008 uses the Legislature’s referendum authority to place the question before the people of Arizona. If approved by voters, the measure would take effect upon proclamation by the Governor.
